1. General

The General Terms and Conditions of Business are drawn up in accordance with the consumer protection regulations, based on the recommendations of the Slovenian Chamber of Commerce and Industry and the international codes for online and electronic commerce.
The online shop “Gota” (hereinafter referred to as the “Online Shop”) is operated by the company Gota webu prodaja d.o.o., which is also a provider of e-commerce services (hereinafter referred to as the “Trader”).

The Buyer is bound by the General Terms and Conditions in force at the time of purchase (placing an online order).
The User is each time reminded of the General Terms and Conditions when placing an order and confirms his/her awareness of them by placing the order.

By registering in the online shop, the visitor acquires a username identical to his/her e-mail address and a password set by the user.
The username and password unambiguously identify and link the user to the data entered.
By registering, the visitor confirms and warrants that he or she is a person of full legal capacity.
By registering, the visitor becomes a user and a member of Gota pets.
Both the guest and the user acquire the right to purchase.
By purchasing a product, the user becomes a customer.
Registration is also possible during the purchase process.
You can edit your data and subscribe to the newsletter later, if necessary, in your user account.

These General Terms and Conditions define the operation of the online shop, the rights and obligations of the visitor, the user and the buyer, and the business relationship between the Trader and the user as a buyer of products from the online shop.

2. Accessibility of information

The trader undertakes to make them available to the user at all times:

  • the identity of the Trader (in particular the company name and registered office and the number of the register where the company is registered);
  • contact details to enable the user to communicate quickly and effectively with the Trader (email address, telephone, etc.);
  • information on the essential features of the products offered by the online shop, including any warranties (if there is no warranty written next to the product, there is no warranty for that product)
  • information on prices, which must be clearly set out and it must be clear whether or not VAT is already included in the price
  • information on the availability of products from the online shop;
  • the method and conditions of delivery of the products or
    the conditions and terms of delivery of the products and services, in particular the place and time limit for delivery;
  • information on how to pay;
  • information about the validity period of the offer from the online shop;
  • information on the period during which it is still possible to withdraw from the contract and the conditions for withdrawal;
  • information on the possibility of returning products or withdrawing from the contract
  • information about the User complaint procedure and the contact details of the Trader’s contact person for Users.

3. Product offer

Due to the nature of doing business online, the product range in the online shop can change and be updated frequently and quickly.

4. Payment methods

The trader allows the user the following payment methods for the purchase of products from the Gota pets online shop:

  • PAYMENT BY PAYMER CARD*:
    is made via the Stripe payment system.
    Card data is not recorded on the company’s server, so your security is 100% guaranteed.
    Stripe guarantees maximum transaction security.
    Credit card authorisations are done in real time with instant verification of data with banks.
    The following cards are accepted for payment.

* Postage and other delivery charges are already included in the payment amount if delivery is chargeable, but for free delivery you only pay the value of the items ordered.

5. Prices

The online price applies to all registered users of the Trader’s online shop.

All prices in the online shop are in euros. All prices in the online shop are the prices of the products and do not include delivery charges (see points 3. and 12.).All prices are valid only for electronic ordering of products via the online shop.

Discounts are not cumulative and promotions are mutually exclusive, unless explicitly stated otherwise.

All prices are valid at the time of ordering and have no pre-determined validity and are therefore valid only until changed from time to time.
Despite the Merchant’s best efforts to provide the most up-to-date and accurate information, it is possible that a price may be incorrect.
In the case referred to in the preceding sentence and in the event that the price of the product changes during the processing of the order, i.e. from the moment of placing the order until the order is confirmed, the Merchant shall:

– notify the user (customer) of the new prices, in which case the user (customer) shall have the option of modifying or cancelling the order in whole or in part or confirming the order at the new prices, all at no additional cost; or

– enable the user (buyer) to withdraw from the purchase and at the same time offer a win-win and mutually satisfying solution.

Deposits made under vouchers, other bonuses and pre-accounts do not earn interest.

The price of goods in the online shop is not adjusted on the basis of automated decision-making.

6. Purchase procedure

  1. Order accepted
    After placing an order, the user (buyer) receives an e-mail from the Trader informing him/her that the order has been accepted.
    Within 1 hour of receiving this notification, the User (Buyer) has the possibility to cancel the order without any consequences.
    Except for the cancellation option, the User (Buyer) cannot change the content of the order after the order has been placed.
    The User (Buyer) shall at all times have access to comprehensive information on the status and content of each order in his/her profile on the Merchant’s website.
  2. Order confirmed
    If the user (buyer) does not cancel the order, the order will be processed further.
    Upon receipt, the trader will review the order, check the deliverability of the products ordered and confirm or reject the order with a reason.
    The trader may also contact the user (buyer) by telephone on the contact telephone number provided to verify the information or to ensure the accuracy of the delivery.
  3. Goods dispatched
    The trader prepares and dispatches the ordered products within the agreed deadline and notifies the user (buyer) by e-mail.

7. Purchase contract and invoicing

When a user buys a product from an online shop, the trader issues an invoice in written or electronic form, with an itemised cost.
The purchase contract in the form of a purchase order is stored electronically on the Merchant’s server and is accessible to the User (Buyer) at any time in his/her user profile.
The Purchase Agreement is concluded in the Slovene language.

8. Vouchers, gift vouchers, value vouchers and loyalty programme

You can use online shop vouchers with a password you have obtained or made public.
To use a voucher, you must first select the product(s) you want to buy, then click on the basket and select “View in basket”.
You will be presented with the option “Use voucher code”, where you enter your password in the box and click “Use voucher”.
The software will calculate the discount itself at the end of the purchase.

9. Right of withdrawal, return of products

Under the Consumer Protection Act (CPPA-1), for distance or off-premises contracts, the consumer has the right to inform the company within 14 days that he or she is withdrawing from the contract, without having to give a reason for the decision.

The consumer can give notice of withdrawal to the company either on a form or by an unambiguous statement that makes it clear that he or she is withdrawing from the contract (which can also be oral, e.g. given over the phone).
The consumer is deemed to have made the withdrawal declaration in time if he sends it within the time limit set for withdrawal.

In the case of withdrawal, the consumer only bears the cost of returning the goods.

The consumer is liable for diminution in the value of the goods if the diminution in value is due to conduct which is not strictly necessary to establish the nature, characteristics and functioning of the goods.

We recommend that you use a delivery service that can track your shipment and that you prepare the goods properly for transport (you can use the original packaging or other suitable secure packaging).
Any return costs will be borne by the buyer.
We do not accept redemption shipments.

In the event of withdrawal from the contract, the company shall reimburse all payments received immediately or, at the latest, within 14 days of receipt of the notice of withdrawal.
The company shall return the payments received to the consumer by the same means of payment as used by the consumer, unless the consumer has expressly agreed to use a different means of payment
and the consumer does not bear any costs as a result.
The consumer shall not be entitled to reimbursement of any additional costs incurred if the consumer has expressly opted for a type of shipment other than the most cost-effective standard shipment offered by the company.
In the case of a sales contract, the undertaking may withhold the reimbursement of payments received until the consumer has taken delivery of the returned goods or until the consumer has provided proof that he has sent the goods back, unless the undertaking offers the option of taking delivery of the returned goods himself.

10. Material defect and warranty

The Seller shall be liable for any non-conformity of the goods existing at the time of delivery of the goods and which becomes apparent within two years of delivery of the goods.

11. Purchases for legal persons

The purchase procedure for legal entities is the same as for natural persons, except that the user registers the company and confirms acceptance of the terms of use.

Legal persons do not have the possibility to withdraw from the purchase contract within 15.
days after acceptance without giving a reason.
However, they may claim defects under a material defect or warranty.

For legal persons, the Gota pets online shop offers the following payment method:

  • BY PREPAYMENT:
    By prepayment of the purchase price to the Trader’s transaction account according to the invoice we send to your e-mail.
    (see point 4 – PREPAYMENT)

12. Delivery

The trader will deliver the ordered products to the user (buyer) within the agreed time limit.
The contractual partner of the Trader for delivery of the items is Pošta Slovenije, kurirska in paketna distribucija, d.o.o..
The Merchant reserves the right to choose another delivery service if this will enable the Merchant to fulfil the order more efficiently.

The delivery date for products in stock for delivery addresses in Slovenia is expected to be the next working day or.
2 working days for orders placed after 12.
12:00.

The flat-rate delivery fee is €3.50 per package.
This price includes the cost of processing the order, packaging and delivery charges.

Every product from the online shop is available within a reasonable timeframe and is on its way as soon as possible.
Delivery of orders placed is only possible within Slovenia.

Post Slovenije will notify the recipient of the scheduled delivery of the parcel via SMS or text message.
e-mail, one day in advance.
If you are not at the address indicated at the time of delivery, the Post Slovenije courier will leave a note in your mailbox with a contact telephone number where you can order a redelivery, which is free of charge.
Post Slovenije will keep your parcel for 4 days, after which it will be returned to the sender.

13. Security and protection of personal data

The trader shall use appropriate technological and organisational means to protect the transmission and storage of personal data.
The security is also the responsibility of the user by ensuring the security of his/her username and password and by ensuring that his/her computer is protected by appropriate software and anti-virus protection.

The trader (Gota pets) undertakes to permanently protect all personal data of the user in accordance with ZVOP-1.

The trader (Gota pets) stores indefinitely the customer’s data such as: first name, last name, email address, contact telephone, address, country of residence, time and date of registration and archive of communication with the trader (with Gota pets).
The Trader (Gota pets) will use the above personal data exclusively for its own purposes (delivery, sending of materials, offers, invoices) and other necessary communication with the Customers.
Under no circumstances will the customer’s data be passed on to unauthorised persons.

14. Communication and newsletters

The trader (Gota pets) will contact the user (buyer) using remote communications, unless the user (buyer) expressly objects to this.

The emails will contain:

  • a clear and unambiguous indication that the advertising messages are
  • the sender of Gota pets will be clearly visible
  • campaigns, promotions and other marketing techniques are labelled and the conditions for participation are clear
  • how to unsubscribe from the newsletter will be clearly explained.

15. Childcare

The trader shall not accept orders in the online shop from someone he knows or suspects to be a child without the express permission of the child’s parents or guardians.
The trader shall not offer free access to products or services in the online shop that are harmful to children.

The trader will not accept any personal data concerning children without the express permission of the parents or guardians, nor will the trader disclose any data received from children to third parties other than the parents or guardians.

Any communication aimed at children will be age-appropriate and will not exploit children’s trust, lack of experience or sense of loyalty.

17. Limitation of liability

The risk of loss of or damage to the goods dispatched passes from the undertaking to the consumer when the goods are physically received by the latter or when the goods are physically received by a third party, other than the carrier, appointed for that purpose by the consumer.

Notwithstanding the preceding paragraph, where the consumer has ordered carriage from a carrier other than that offered by the undertaking, the risk of loss of or damage to the goods shall pass to the consumer on delivery of the goods to the carrier, without prejudice to the rights which the consumer may have against the carrier.

18. Non-acceptance of products

The customer is obliged to collect the ordered items within a certain period of time from the receipt of the electronic notification of the completed order, the sms confirmation of the completed order or the confirmation by e-mail.
If the Buyer does not collect the ordered items, which are sent COD, in any case, and they are returned to the address of the company after the waiting period at the Post Office of Slovenia (4 days), this shall NOT be considered as a withdrawal from the contract, since the latter is still validly concluded and it is a unilateral unannounced withdrawal of the Buyer from the contract.
In the event of non-acceptance, the Buyer is thus liable for the costs of additional shipping/return of the items to the Company, for the economic damage caused by the inability to advertise the ordered items that have been in distribution for 4 days or more.
In the event of non-acceptance, the case shall be referred to the Legal Department, which will, under our authority, further arrange for the payment and recovery of the costs and damages incurred.

19. Complaints, disputes and application of the law

The trader complies with applicable consumer protection laws.
The trader has an effective complaints handling system in place and has a designated person who can be contacted by phone or email in case of problems.
In case of problems, the user (buyer) may contact the following e-mail address: info@gota-pets.com.
The complaint handling procedure is confidential.

The trader will acknowledge receipt of the complaint within five working days, let the user (customer) know how long it will take to process the complaint, and keep the user (customer) informed of the progress of the complaint.
The Trader will use its best endeavours to resolve any disputes amicably.
If no amicable settlement is reached, the Ljubljana court shall have exclusive jurisdiction to settle all disputes between the Merchant and the User (Buyer).
The Merchant and the User (Buyer), as participants in electronic commerce, mutually acknowledge the validity of electronic messages in court.

These General Terms and Conditions and any disputes between the Merchant and the User (Customer) shall be governed by and governed by the substantive and procedural law of Slovenia, without giving effect to any rules of private international law that would refer to the application of any other law.

The provisions of the Code of Obligations, the Electronic Commerce Act, the Personal Data Protection Act and the Consumer Protection Act shall apply mutatis mutandis to all relationships and rights and obligations not governed by these General Terms and Conditions.

20. Out-of-court settlement of consumer disputes

In accordance with the legal norms, the online shop www.gota-pets.com, owned by Gota Online Sales d.o.o., does not recognise any provider of out-of-court consumer dispute resolution as competent to resolve a consumer dispute that a consumer may bring under the Act on Out-of-Court Settlement of Consumer Disputes.

Gota Online Sales d.o.o., which as a provider of goods and services facilitates online trade in the territory of the Republic of Slovenia, publishes on its website an electronic link to the Online Consumer Dispute Resolution Platform (ODRP).
The platform is available to consumers here.

These rules are based on the Law on Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No.
524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No.
2016/2004 and Directive 2009/22/EC.

21. Changes to the General Terms and Conditions

In the event of changes in the regulations governing the operation of online shops, data protection and other areas related to the operation of the online shop of the Merchant and in the event of changes in its own business policy, the Merchant may amend and/or supplement these General Terms and Conditions of Business, which will be notified to the Users in an appropriate manner, in particular through the website www.gota-pets.com.Any amendments and/or supplements to the General Terms and Conditions of Business shall enter into force and apply at the end of an eight-day period from the date of publication of the amendments and/or supplements.
If a change and/or amendment to the General Terms and Conditions is necessary to comply with the regulations, these changes and/or amendments may exceptionally enter into force and application within a shorter period of time.

A User who does not agree with the amendments and/or additions to these General Terms and Conditions must cancel his/her registration within eight days of the publication of the notice of the amendment and/or addition to the General Terms and Conditions, otherwise, after the expiry of this period, the User shall be deemed to have accepted the amendments and/or additions to the General Terms and Conditions and no evidence to the contrary shall be admissible.
Cancellation of registration shall be made by the User notifying the Merchant of the cancellation by written statement.

The General Terms and Conditions of Business were adopted by Gota Web Sales d.o.o., Tržaška cesta434A, 1351 Brezovica pri Ljubljani on 17.6.2024.

22. Description of the technical means of identifying and correcting defects before the award of the contract

Before the customer submits the order, he/she will be taken to the ORDER REVIEW AND SUBMIT window, with the prompt “Please review the above order details and submit when you are ready.”.
In the entry you can check the information you have filled in for the purpose of placing the order.
In case of incorrect data entry, you can change the data by clicking on the “EDIT” button.
At this step, the customer can change the customer details, the delivery address, the delivery method, the payment method and the billing address.

Privacy Policy

The operator of the online shop Gota pets, Gota online sales d.o.o. is obliged to protect the personal data of its users in accordance with the Personal Data Protection Act (ZVOP-1-UPB1).

For the purposes of operating the Gota pets online shop, the following user data is collected:

  • first and last name,
  • address with post code,
  • e-mail (which is also your username),
  • phone number,
  • password in encrypted form,
  • other information entered in the forms in the Gota pets online shop.

The accuracy of the information you enter or provide to us is guaranteed.
We are not responsible for the accuracy of the information you provide.
We only use contact information when it is necessary to contact a visitor and to send occasional information material.

To ensure security, the IP addresses from which users access the website are also collected.
At the start of a visit, each user is assigned a session cookie to identify and keep track of their shopping basket.
Among other things, the Gota pets online shop may also store other cookies on your computer, such as: a user identification number in encrypted form (to identify the user on the next visit), product ratings (so you know which products you have already rated) and Google Analytics cookies (to analyse website traffic).

All of the aforementioned data, except for cookies, is permanently stored on the server of the Gota pets online shop.
Session cookies are only stored in the server’s memory for the duration of the visit and are deleted after a short period of inactivity.
Persistent cookies, on the other hand, are stored on the visitor’s computer.

Cookies enable the managers of the Gota pets online shop to keep a record of visits to the website and enable users to make the online shop work better. This technology does not collect personal data about individual users. The sole purpose of this is to improve the content and use of the portal.

Under no circumstances will Gota pets pass on user data to unauthorised persons. The delivery service (in our case, Post Slovenije) will only be entrusted with the user’s address for delivery purposes. We will only contact the user by means of distance communication, if necessary, if the user does not otherwise expressly object to this.
